Legal Assistance

We provide legal assistance by appointment to eligible personnel covering a variety of services including but not limited to: divorce, child-custody, consumer law, land-lord tenant issues, and the Servicemembers Civil Relief Act (SCRA). Wills and Powers of Attorney/Advanced Medical Directives (AMDs) are also available as estate planning services (details and instructions below). Personnel eligible for legal assistance appointments are active duty members and their dependents, and those covered by AFI 51-304, para. 2.3.

Please note—ethical rules prohibit our attorneys from providing legal assistance on matters where a person is already represented by any outside attorney, or those matters that are punitive in nature like traffic tickets or off-base criminal matters.

Claims Assistance

Under the Federal Tort Claims Act (FTCA), individuals who are injured, or whose property is damaged by the negligent or wrongful act of a federal employee acting within their official duties, can file a claim with the government for reimbursement. A more detailed overview of claims against the government can be found here.

In order for our office to be able to process a claim, the claimant must fill out an SF95, which can be submitted either in person during walk-in hours or sent via email to our org box (see above). The processing timeline for claims can be up to 6 months and begins with our receipt of your claim with a filled out SF95.

Claims for damage to vehicles and household goods resulting from DTS shipments are processed through the Air Force Claims Service Center. Please contact the AFCSC at 1-877-754-1212 or visit https://claims.jag.af.mil to complete all necessary documentation.

NOTARIES and POAs:

Notaries and Powers of Attorney (POAs) are available on a walk-in basis to those eligible for legal assistance, as described above. Please call or email to schedule an appointment if you need more than five documents notarized, or more than three powers of attorney.  

VICTIM ASSISTANCE

The Victim and Witness Assistance Program (VWAP) is a Commander-directed program that is supported by the Legal Office. VWAP provides guidance for the treatment of victims and witnesses of crimes covered under the UCMJ. Using a multi-disciplinary approach, the program ensures that victims and witnesses receive the information and assistance to which they are entitled. If you need an appointment, please call the legal office to schedule with our VWAP coordinator.

WILLS and ESTATE PLANNING:

Estate planning, consisting of Wills, POAs, and AMDs, is currently available to active-duty members and their dependents, and in some cases, reservists. Will appointments require a ticket number for an estate planning worksheet at the time of booking. See instructions for completion of a will worksheet (and getting a ticket number) below:

Each person who wants a Will appointment must have a separate ticket number.

military justice

The Military Justice section of the legal office reviews evidence and provides advice to commanders and first sergeants on appropriate disciplinary actions ranging from Letters of Counseling/Admonishment/Reprimand, non-judicial punishments (Article 15's), and administrative discharges to courts-martial and UCMJ actions. Air Force courts-martial are open to the public. The docket of upcoming courts-martial is found at: www.afjag.af.mil/docket/index.asp.

Tax Assistance

The Davis-Monthan AFB Volunteer Income Tax Assistance (VITA) Office volunteers are trained and certified by the IRS to prepare a variety of tax documents for our military community. This is a free service for Active Duty, National Guard, Reserve, or Public Health personnel, Military Retirees, or dependents of those categories with access to the base.

Assistance is by appointment only.

During tax season, eligible persons can call VITA directly for assistance at 520-228-3489. If outside of tax season, please call or email the legal office for an appointment.

AREA DEFENSE COUNSEL

The Area Defense Counsel (ADC) provides independent legal counsel to service members who are facing any adverse administrative actions or are suspected of committing an offense under the Uniform Code of Military Justice.
